Personal Injury Matters in Dallas-Fort Worth

Review of injury claims, insurance records and available options, with contingency fees and case-cost responsibility explained in writing.

An injury claim brings together several questions at once: what happened, what the records show, which coverage may apply and what the injury has changed in your life. Omer reviews those questions before recommending a scope of representation. The firm evaluates accident claims with attention to both the evidence and the practical cost of pursuing recovery. You receive the proposed fee terms in writing. Medical decisions remain between you and your health care providers, and you decide whether to accept a settlement after receiving advice.

How we can help

  • Review of accident records, coverage and the available evidence
  • Pre-suit claims, demand preparation and negotiation within an agreed scope
  • Assessment of whether litigation serves the client's interests
  • Routine collection of your own PIP or MedPay benefits without an attorney's fee, with disputed coverage scoped separately

Fees and costs

Personal injury attorney's fees are a percentage of the gross recovery: 33 1/3 percent if your claim resolves before a lawsuit is filed, 40 percent if it resolves after a lawsuit is filed, and 45 percent if it resolves after trial begins. Trial begins when jury selection starts or, in a trial before the judge alone, when the first evidence is presented. The fee is calculated on the gross recovery before case expenses are deducted. Appeals require a separate written agreement.

Case expenses, such as filing fees, records, depositions and expert witnesses, are separate from the attorney's fee and are the client's responsibility, including if there is no recovery, unless we agree otherwise in writing. We explain the payment arrangements before you hire us.

We charge no attorney's fee for routine collection of your own PIP or MedPay benefits. Disputed coverage requires a separate scope.

Example only. A claim settles for $30,000 before a lawsuit is filed. The attorney's fee is $10,000. Case expenses of $600 and medical bills of $8,000 are paid from the recovery. You receive $11,400.

Common questions

What percentage will the firm charge?

33 1/3 percent of the gross recovery if your claim resolves before a lawsuit is filed, 40 percent if it resolves after a lawsuit is filed, and 45 percent if it resolves after trial begins. Your written agreement states the percentages, what work they cover and how the fee is calculated. Appeals require a separate written agreement.

Who pays case expenses?

You do, including if there is no recovery, unless we agree otherwise in writing. The written agreement lists the kinds of expenses involved, such as filing fees, records, depositions and expert witnesses. Any arrangement for the firm to advance particular costs requires a separate written agreement that states what is covered and how it is repaid.

Does a case have to go to trial?

No. The available evidence, offers, costs and risks inform the decision. Omer advises you on the options, and you decide whether to settle. Litigation requires an agreed scope and a reason to proceed.
